TMG SMS Terms & Conditions

1. Definitions 

  • “Opt In” means your affirmative consent to receive SMS messages from TMG by texting a keyword, checking a box on a web form, or otherwise providing your mobile number. 

  • “SMS Service” means any text‐based communications (SMS, MMS, or successor protocols) we send to your mobile device. 

  • “HELP” is the keyword you can text to our long code or short code to receive customer support instructions. 

  • “STOP”, “QUIT”, “END”, “CANCEL”, or “UNSUBSCRIBE” are the keywords you can text to opt out of the SMS Service.

2. Consent & E-Sign Disclosure 

By opting in, you: 

  • Consent to receive recurring text messages from TMG at the mobile number you provide. 

  • Agree that electronic records (including SMS) satisfy any legal requirement that communications be in writing. 

  • May withdraw consent to electronic records by replying STOP to any message. 

Consent is not a condition of purchasing any goods or services.

3. Message Frequency & Cost 

  • Frequency: Msg frequency varies based on your interactions with our SMS Service. You may receive an initial confirmation message and subsequent replies as you use the service. 

  • Cost: TMG does not charge for messages. Msg & data rates may apply depending on your wireless plan.

4. Opt-Out & Help 

  • To unsubscribe: Reply STOP, QUIT, END, CANCEL, or UNSUBSCRIBE. You will receive a one‐time confirmation message; thereafter, no messages will be sent unless you opt in again.

5. Sharing & Use of Data 

  • We use your phone number and SMS content solely to provide and improve the SMS Service, respond to your inquiries, and for fraud prevention. 

  • We share SMS data only with:  

  • Service providers (platform vendors, carriers) who facilitate message delivery. 

  • Law enforcement or regulators as required by law. 

  • Successors in the event of a merger or sale of assets. 

  • We do not share or sell your mobile number or opt-in data for third-party marketing.

6. Arbitration & Governing Law 

  • These Terms are governed by the laws of Virginia, without regard to conflict-of-laws rules. 

  • Any dispute arising under these Terms will be resolved by binding arbitration in Virginia Beach, VA, in accordance with the American Arbitration Association’s rules. 

  • You and TMG waive any right to a class action or jury trial.

7. Changes to Terms 

We may update these Terms at any time. The new “Effective Date” will be posted here. Continued use of the SMS Service after changes constitutes acceptance.

This policy applies solely to TMG’s SMS Service and does not govern data collected through our website, apps, or other channels. 

 

2. Information We Collect 

  • Subscriber Data: Your mobile phone number and SMS keyword responses.

  • Usage Metadata: Date, time, and technical data (carrier, message delivery status).

  • Law enforcement, regulators, or courts as required by law. 

  • Successors in the event of a business sale or merger. 

We do not disclose your number or SMS opt-in data for marketing by third parties. 

 

5. Data Retention & Security 

  • We retain SMS data only as long as necessary to provide the service, fulfill legal obligations, and resolve disputes. 

  • We implement industry-standard safeguards (encryption, access controls) to protect your information. 

  • No system is completely secure; absolute security cannot be guaranteed. 

 

6. Children’s Privacy 

Our SMS Service is not directed to children under 13. We do not knowingly collect or maintain information from anyone under 13. 

 

7. Your Rights (CCPA/GDPR) 

If you are a California resident or EU citizen, you may: 

  • Request access to or deletion of your data.
